These Terms & Conditions (“Terms”) govern your access to the DuckCast website, your purchase of a DuckCast license, and your use of the DuckCast application (the “Software”), all operated by the DuckCast team (“we,” “us”). By using the site or the app, you agree to these Terms, including the license terms in sections 4–6.

1. The service

DuckCast is a macOS application for browsing and querying local databases and data files. A free tier is available with limited windows and tabs; a paid license removes those limits. Features may change over time as the app evolves.

2. Purchases & payment

Orders are sold and fulfilled by our reseller Paddle, which acts as the Merchant of Record. When you buy a license, you also agree to Paddle’s buyer terms. Paddle handles billing, applicable taxes (such as VAT and sales tax), and invoicing. Prices are shown at checkout and may change for future purchases.

3. Refunds

We offer a 14-day money-back guarantee, described in our Refund Policy. Refunds are processed through Paddle.

4. Your license

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable license to install and use the Software:

A license key is personal to you. You may not sell, sublicense, rent, lease, share, or otherwise distribute your key. If you replace or reinstall your Mac, you may deactivate and re-activate your license on the new machine.

A license includes updates delivered through the app’s built-in updater (Sparkle). We may release updates that add, change, or remove features. We are not obligated to provide updates indefinitely.

7. Intellectual property

The Software is licensed, not sold — purchasing a license grants you the right to use the app, not ownership of it. DuckCast, its name, logo, and the app’s original code and design are owned by us, and we retain all intellectual property rights in the Software. These Terms grant you no rights to our trademarks. DuckCast is built on the open-source DuckDB engine and other open-source components, each provided under its own license, which continues to apply to those components.

8. Disclaimer of warranties

The website and app are provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the app will be error-free or uninterrupted. You are responsible for backing up your data; always keep copies of important files.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data or profits, arising out of your use of the app or website. Our total liability for any claim is limited to the amount you paid for your license in the twelve months before the claim.

10. Termination

Your license is effective until terminated. It terminates automatically if you breach these Terms, at which point you must stop using the Software. Sections that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — will survive.

11. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the latest version. Continued use after changes take effect constitutes acceptance.
